In addition, DSC strongly recommends that users of video test products/charts/cards perform appropriate tests of such products/charts/cards prior to their use for video/film production. It is a condition of the use of DSC products that in no event shall DSC be liable under any legal or equitable theory for any direct, indirect, incidental, exemplary, punitive, consequential or third party damages (including, without limitation, for loss of use, lost revenues, lost profits, loss of expected savings or any kind of loss of business goodwill or opportunity) whether or not DSC has been advised of the possibility of such loss or damages, and in no event shall DSC's liability to you exceed the amounts actually paid by you to DSC for the DSC products or services which gave rise to any claim. While DSC makes every reasonable effort to provide products and services in a timely manner, specific delivery times cannot be guaranteed. Prices are subject to change without notice. DSC Products: DSC warranties products against defects in materials and workmanship for a period of one year from date of purchase. Customer's sole remedy in the event of any defects arising during the warranty period is, at DSC's option, the replacement of the defective product or the refund of a pro-rated portion of the original purchase price.
Intellectual Property and Copyright
It is the responsibility of DSC customers to ensure that they either own or have otherwise obtained the rights to print, reproduce, or modify all materials submitted to DSC for reproduction. DSC assumes no liability for infringement of any such rights, and it is a condition of all work performed by DSC that the customer agrees to indemnify DSC against any actions, damages or costs which may be incurred by DSC as a result of or in connection with any claims arising from any alleged infringement of copyright or other intellectual property rights made in connection with any work performed by DSC, its staff or subcontractors on the customer's behalf.
